This Privacy Policy describes how Nexcell ("Nexcell"), a service operated by Nexcell Surgical Specialists, LLC, a New Mexico limited liability company ("we," "us," "our"), collects, uses, and shares information from visitors and patients. Protected health information ("PHI") we collect as a covered entity under HIPAA is governed by our HIPAA Privacy Practices Notice, available at /hipaa-privacy-policy.
2. Information We Collect
Information You Provide
We collect information you submit to us, including:
- Contact details — name, email, phone, mailing address, and city/state when you complete a form.
- Health-related information you choose to share through forms, including wound type, duration, insurance carrier, and a brief clinical description.
- Communication preferences, including whether you opt in to marketing or transactional text messages.
- Referral details if you submit a referral on behalf of a patient.
Information Collected Automatically
When you use the Site, we may collect:
- Device and browser information (browser type, operating system, screen size).
- Approximate location based on IP address.
- Pages visited, time on page, and how you arrived at the Site (referrer).
- Cookies and similar technologies as described in Section 7.
Information from Third Parties
We may receive information from analytics providers, advertising platforms (such as Google Ads), and your insurance carrier when verifying coverage.

We do not sell your personal information. We may share information with:
- Service providers (hosting, analytics, communications, payment processors) who handle data on our behalf under contractual obligations.
- Healthcare partners (referring providers, home health, surgeons) as needed for your care, in accordance with HIPAA.
- Legal and regulatory bodies when required by law.

5. SMS / Text Messaging
If you opt in to receive text messages from Nexcell, message frequency varies. Standard message and data rates may apply. Reply STOP to any message to unsubscribe; reply HELP for help. Marketing and transactional text consent are collected separately and either is fully optional. Consent to receive SMS is not a condition of receiving care or services.
6. Your Choices
- You may unsubscribe from email lists using the link at the bottom of any email.
- You may stop SMS messages at any time by replying STOP.
- You may request to access, correct, or delete information we hold about you by contacting hello@nexcell.org. Some records (including medical records) may be retained as required by law.
7. Cookies & Analytics
The Site uses cookies and similar technologies for site functionality, analytics, and (where applicable) advertising measurement. You can control cookies through your browser settings. Disabling cookies may affect Site functionality.
We use Google Analytics 4 (measurement ID G-2ST0FH2M9J) and the Meta Pixel (ID 1989525531654668) to measure website traffic, form completions, and ad performance. 8. Children
The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13.
9. Data Security
We use reasonable administrative, technical, and physical safeguards to protect information. No method of transmission or storage is 100% secure.
10. Third-Party Links
The Site may link to third-party websites. Their privacy practices are governed by their own policies, not this one.
11. California, Colorado & Other State Privacy Rights

We may update this policy from time to time. The "Last Updated" date at the top of the page reflects the latest revision. Material changes will be posted on the Site.
SMS Communications and Opt-In
Nexcell, a service of Nexcell Surgical Specialists, LLC, offers SMS (text message) communications to patients and prospective patients who explicitly opt in via the contact and intake forms at https://nexcell.org/contact, https://nexcell.org/referral, and any other form on https://nexcell.org that collects a phone number. Two separate, unchecked checkboxes are provided on each form: one for marketing messages and one for transactional messages. Both are optional, and consent is never a condition of receiving care from Nexcell.
Information collected for SMS: When you opt in to SMS, we collect your mobile phone number, the consent timestamp, the consent URL, your IP address, and which checkboxes you affirmatively selected.
How we use SMS information: Phone numbers are used solely to deliver the type of messages you have consented to (marketing or transactional). Phone numbers are processed through our messaging provider (Twilio, via GoHighLevel) under a Business Associate Agreement (BAA) where applicable for HIPAA-related communications. Patient health information (PHI) is never sent over SMS — only general scheduling, logistical, and educational content.
No third-party sharing of SMS opt-in data: We do not share, sell, rent, or transfer mobile phone numbers, SMS opt-in status, or any data collected through the SMS consent process to third parties or affiliates for their marketing purposes. SMS opt-in data is used exclusively by Nexcell to communicate directly with you.
Opting out: You may opt out of SMS messages at any time by replying STOP to any text message. You may also reply HELP for help. Standard message and data rates may apply. Message frequency varies based on the type of consent provided — typically 2 to 6 marketing messages per month and 4 to 12 transactional messages per month per active patient.
Data retention: SMS consent records (timestamp, IP address, consent version, and the form URL where consent was captured) are retained for as long as your relationship with us is active and for a minimum of seven (7) years thereafter as required by HIPAA, New Mexico medical recordkeeping rules, and TCR carrier audit standards.
